Supply Terms
Offer to Purchase
By submitting a Purchase Order for a product on the Website, or by paying for a TurboMale Account, you represent and confirm that you:

Payment

- All payments for your TurboMale Account must be made upfront monthly before the start of the next month;
- If we issue an invoice to you, payment must be made by the specified time in the invoice;
- For all other purchases, payment must be made upfront prior to dispatching the Goods for delivery;
- You must not offset any alleged debts from TurboMale against money owed by you to us;
- Amounts stated on the Website do not include GST unless indicated. In case of GST payable for a taxable supply by TurboMale, you must pay the GST upon receipt of a tax invoice;
- Payment for all goods and/or services can be made via PayPal, Stripe, Credit Card, or Electronic Funds Transfer;

Cancellation

Delivery and Shipping

Title and Risk
Until the price of Goods is paid in full, title in those Goods is retained by TurboMale.

- you authorise TurboMale, its employees and agents to enter any premises occupied by you or any other place where the Goods are located and use reasonable force to retake possession of the Goods without liability for trespass or any reasonable damage;
- TurboMale may at its option keep or resell Goods retaken from you; and
- if you sell Goods or items into which the Goods are incorporated before payment in full to TurboMale, you acknowledge that such sale is made by you as bailee for and on behalf of TurboMale, to hold the proceeds of sale on trust for TurboMale, in an account in the name of TurboMale, and you must pay that amount to TurboMale on demand.
Customs and Duties
TurboMale reserves the right to refuse international orders. Approved international orders may be subject to customs and import duties in the destination country. You are responsible for paying all customs and import duties, and acknowledge that failure to pay may result in your order being held at customs. We will not be liable for any costs incurred in releasing your order from customs, including reimbursing you for any customs or import duties paid.
Returns & Exchanges
Returns of Goods will only be accepted if:

Change of Mind Return: We do not accept returns due to change of mind, given the nature of the products.

If we suspect your Goods may be faulty, we will ask you to return the product, along with any accessories, manuals, documentation, or registration included, at your cost for further inspection. We reserve the right to inspect the product before deeming it faulty.
If we find the product is not faulty, or the fault is due to wear and tear, misuse, failure to follow instructions, or lack of reasonable care, we will refuse the return and send the product back to you at your own cost.
If the product is determined to be faulty, you will be refunded the full amount paid (including shipping costs). You may request a refund, exchange, or store credit. Refunds will be credited back to your original payment method, unless you request and we approve an alternative method.
If you do not comply with this clause for defective Goods, we may issue a partial refund or no refund at our discretion. This clause does not limit any manufacturer warranties or your rights under applicable law.

Jurisdiction: Each party irrevocably submits to the exclusive jurisdiction of the courts of Victoria, Australia, and courts of appeal from them in respect of any proceedings arising out of or in connection with this agreement. Each party irrevocably waives any objection to the venue of any legal process on the grounds that the process has been brought in an inconvenient forum.

Assignment: A party cannot assign, novate, or otherwise transfer any of its rights or obligations under these Terms without the prior written consent of the other party.
Entire Agreement: These Terms constitute the entire agreement between the parties and supersede any prior negotiation, conduct, arrangement, understanding, or agreement, express or implied, in relation to the subject matter of these Terms.

In these Terms, the following rules of interpretation apply:

- A reference to a party includes that party's executors, administrators, successors, and permitted assigns, including persons taking by way of novation, and, in the case of a trustee, any substituted or additional trustee.
- A reference to a party, clause, paragraph, schedule, exhibit, attachment, or annexure is a reference to a party, clause, paragraph, schedule, exhibit, attachment, or annexure to or of these Terms. A reference to these Terms includes all its schedules, exhibits, attachments, and annexures.
